Kenya Plastics Pact Releases Position Paper on EPR Regulations Court Order

The Kenya Plastics Pact (KPP) has released its official position paper addressing the recent High Court order temporarily halting the implementation of the Sustainable Waste Management (Extended Producer Responsibility) Regulations, 2024.

KPP unequivocally reiterates its strong support for these regulations, which are crucial for Kenya’s environmental sustainability. As stated in our position paper, “The Kenya Plastics Pact was not merely a passive observer but an active participant in the development of these regulations, contributing insights and expertise to ensure they are robust, practical, and aligned with the overarching goal of establishing a circular economy for plastics in Kenya.”

While we respect the legal process, we believe that “prolonged delays in implementing these vital regulations will only exacerbate our country’s waste management challenges.” The temporary suspension risks undermining significant progress already made in preparing for EPR implementation.

KPP calls for several key actions moving forward:

“We call upon all producers, manufacturers, importers, and brand owners to proactively continue their preparations for EPR compliance,” including assessing product portfolios and exploring sustainable packaging alternatives.

We advocate for “an intensification of collaborative efforts among NEMA, KEPSA, industry associations, individual businesses, civil society organizations, and county governments” to ensure the EPR framework is both environmentally effective and economically viable.

The Kenya Plastics Pact remains committed to being “a central hub for collaboration, knowledge-sharing, and capacity-building” throughout this process.
